This Anti-Scraping and Automated Access Addendum ("Addendum") is incorporated into and forms part of the The Product Report Terms of Service. By accessing https://theproductreport.com, you agree to this Addendum. If you do not agree, you must immediately cease all access to the Site.

1. Definitions

"Automated Access" means any access to the Site by software, bots, crawlers, spiders, scrapers, data mining tools, automated scripts, headless browsers, or any non-human agent, regardless of the technical method employed. "TPR Data" means all data, content, scores, rankings, lab findings, test results, compliance determinations, product assessments, text, images, and any other information published on or accessible through the Site, in any format. "Competing Database" means any collection, database, dataset, index, or repository that contains TPR Data and is used to offer services that compete with or substitute for The Product Report.

2. Prohibition on Automated Data Collection

You are expressly PROHIBITED from engaging in any of the following without prior written permission from TPR Ops, LLC: (a) Scraping, crawling, spidering, indexing, or harvesting TPR Data by any automated means, including but not limited to use of: web scrapers (Scrapy, BeautifulSoup, Playwright, Puppeteer, Selenium, or similar tools); HTTP request libraries (requests, curl, wget, axios, httpx, or similar); browser automation or headless browser tools; or any software that programmatically accesses the Site. (b) Using data mining, extraction, or collection tools to access, copy, aggregate, or store TPR Data. (c) Circumventing, disabling, bypassing, or defeating any technical protection measure, access control, rate limit, bot detection system, CAPTCHA, or authentication barrier implemented by The Product Report, whether implemented in software, infrastructure, or network configuration. (d) Accessing any honeypot, decoy, or canary data entry intentionally placed on the Site for the purpose of detecting unauthorized automated access. (e) Building, populating, maintaining, or contributing to any Competing Database from TPR Data. (f) Redistributing, sublicensing, selling, or otherwise making TPR Data available to any third party. (g) Reproducing TPR Scores, lab findings, test methodologies, or compliance determinations in any publication, product, service, or database without express written license.

3. Permitted Automated Access

The following automated access is expressly permitted without prior written consent: (a) Crawling by the following search engine bots for the sole purpose of indexing the Site for organic search results: Googlebot, Bingbot, DuckDuckBot, Baiduspider, Yandex, and Applebot. Such access is governed by the robots.txt file located at https://theproductreport.com/robots.txt. (b) Access by accessibility tools (screen readers, browser extensions) for personal non-commercial use. To obtain a license for other programmatic access, contact legal@theproductreport.com with your intended use case, expected request volume, and commercial relationship to The Product Report.

4. Technical Protection Measures

The Product Report employs active technical protection measures ("TPMs") including but not limited to: rate limiting, bot detection systems, IP reputation filtering, behavioral analysis, honeypot data entries, and per-session data watermarking. NOTICE: The existence of these TPMs is expressly disclosed herein. Any person who circumvents, or attempts to circumvent, these TPMs does so with full knowledge and intent, satisfying the scienter requirements of applicable law. Circumvention of these TPMs may constitute a violation of the Digital Millennium Copyright Act (17 U.S.C. § 1201), the Computer Fraud and Abuse Act (18 U.S.C. § 1030), and applicable state computer trespass statutes.

5. Data Watermarking Notice

TPR Data delivered through the Site and API may contain invisible, per-session digital watermarks embedded using steganographic techniques. These watermarks are designed to trace the origin of data that appears in unauthorized databases or publications back to the specific session or account from which it was obtained. The presence of these watermarks does not diminish their legal effectiveness. Possession of watermarked TPR Data without authorization is evidence of unauthorized access, regardless of the possessor's awareness of the watermark.

6. Liquidated Damages

Because the actual damages resulting from unauthorized automated access and data collection are inherently difficult to calculate (including but not limited to: lost subscription revenue, competitive harm, degraded data exclusivity, and erosion of the commercial value of TPR Data), the parties agree that the following liquidated damages are a reasonable pre-estimate of harm and are not a penalty: For each TPR Data record accessed, copied, or stored in violation of this Addendum: USD $100 per record. For purposes of this section, "record" means each unique product entry, score, lab finding, or test result accessed in violation. Access to a single product page containing multiple data points (e.g., score + lab finding + compliance status) constitutes access to multiple records. Liquidated damages are in addition to, and do not limit, any other remedies available to TPR Ops, LLC.

7. Injunctive Relief

TPR Ops, LLC reserves the right to seek immediate injunctive and other equitable relief in any court of competent jurisdiction without the requirement of posting bond or other security, in addition to all other remedies at law or equity. You acknowledge that a violation of this Addendum would cause irreparable harm to TPR Ops, LLC for which monetary damages would be inadequate.

8. Reservation of Claims

TPR Ops, LLC expressly reserves all claims and causes of action arising from violations of this Addendum, including but not limited to: (a) Computer Fraud and Abuse Act (18 U.S.C. § 1030) — unauthorized access to a protected computer; (b) Digital Millennium Copyright Act (17 U.S.C. § 1201) — circumvention of technological protection measures; (c) State computer trespass and unauthorized computer access statutes (including Colorado C.R.S. § 18-5.5-102 and applicable statutes in the jurisdiction of the violator); (d) Copyright infringement under 17 U.S.C. § 501 for unauthorized reproduction of copyrighted TPR Data; (e) Breach of contract; (f) Unjust enrichment; (g) Tortious interference with business relations; (h) Any other applicable federal or state claim. The foregoing list is illustrative and non-exhaustive. Failure to list any particular claim does not constitute a waiver.

9. Enforcement

TPR Ops, LLC actively monitors for violations of this Addendum using both automated and human review. Violations detected through technical means (including honeypot access and watermark detection) may be referred to law enforcement or used in civil litigation without prior notice to the violator. If you believe you have accessed the Site in a manner that may violate this Addendum, contact legal@theproductreport.com immediately. Voluntary disclosure prior to formal notice may be considered in determining the appropriate remedy.

10. Governing Law and Venue

This Addendum is governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any dispute arising under this Addendum shall be subject to the exclusive jurisdiction of the state and federal courts located in Cheyenne, Wyoming. You consent to personal jurisdiction in such courts and waive any objection to venue.

11. Severability

If any provision of this Addendum is held invalid or unenforceable, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

12. Updates

TPR Ops, LLC may update this Addendum at any time. The effective date at the top of this page reflects the most recent revision.
